hey tipp tapp-

there is a funny story behind this. this idea was done year ago by 2 guys at a brazilian agency. at that time it was for eye-drops. since then, these two guys moved to DDB berlin and recycled their same fucking idea, this time for sunglasses.

the CD at their former agency is a bit pissed-off right now, as you may imagine.

There has been some fuzz in Brazil about this.

Apparently, it was was spec piece from their book.
They pitched to the client in Brazil, but he didn't buy it. So it was never published.

They moved to DDB Berlin and pitched the same idea, with a few changes, to one of the agency's clients, which bought it and agreed to produce it properly.

It's not their former CD that is pissed (he is not even at that agency anymore), but the guy that owns that agency. He claims the idea is the agency's, even though it was never produced.

The agency is quite small, so a lot of people think he is just after some media attention.

Answer is simple...who owns a novel? the one who rote it or one who buys it. The book maybe the reader's, but the ovel, still the writer's...correct me if am wrong.

It's not that simple... most of the agency write it in their employement-contract: "all ideas belong to the agency".
So, if you have an idea during worktime (and show it to your boss), legally it's not your property anymore...

or: just think about the beatles-songs: who onwns them? it's not Paul mcCartney, its Micheal Jackson (correct me, if i'm wrong)

There's a difference between being the inventor of an idea and the owner.
sure, you can put an idea in your book, but you musn't do just what you want with it, cause your agency (ex-agency, whatever) has all the copyrights... sorry, can't expain better, as i'm not native: just ask a laywer.
