hello creatives,
can someone please help me with the legality of using a trademarked word in the headline.
i'm currently working on the ad of the new boutique hotel "built with motorcycle enthusiasts and business travelers" in mind (just different amenities like covered motorcycle parking, stronger jacket hooks, boot bench, motorcycle rentals, unique conference rooms, hi-end catering, and etc). Current tag line is "Road warriors welcome", as business travelers and riders are referred to as "road warriors".
So, one of the headlines reads "Where blackberry meets black leather", are we allowed to use "Blackberry" in our headline? would "blackberry is a registered trademark of..." disclaimer on the bottom be enough not to violate any copyright?

You'd have to check if they registered only the word-brand-combination (meaning the visual brand and the name) or the word "blackberry" in this context on it's own (electronic devices). If the first, you could use "blackberry", if you don't use the company's typography or logo. But I think they also registered the word-construct so it's definetely a violation. you'd need the approval to do so.
in belgium you pay extra for the media if mentioning two brands in one ad
check that too :-)
