who owns the IDEA?

Hi Everybody,

Who owns the IDEA, if some creative person work in an Ad Agency and his work got a prize from a creative award, and he applied under his company name.

who own the idea? the creative person or the company he works on?

The agency. You work for them, having brilliant ideas is what they're paying you for.

But an idea can't really be owned by anything or anyone, hence the numerous copycats you see daily on the front page and on www.joelapompe.net

Well, if it's blatent plagiarism, the agency or even the client could sue them, depending on the kind of copyright laws existing in your country.

But anyhow, you can't personally sue anyone for something you did for your company. Again, laws maybe different from one country to another, but you don't own the work you do in your agency.

There are no laws against copying an idea. It's not black and white issue. Someone's 'plagiarism' is someone else's 'inspiration'.
